Abbey Spanier is currently investigating potential state law claims against Brinker International, Inc. and Brinker Restaurant Corporation for allegedly charging its customers automatic service charges for private dining events and other meals at its restaurants (Maggiano's Little Italy and Chili's Grill & Bar, Romano's Macaroni Grill) across the nation but failing to distribute all or a portion of these proceeds to its wait staff employees. Under certain state tipping laws, restaurant management is prohibited from pocketing any portion of an automatic service charge that purports to be a gratuity or a tip intended for the wait staff.
