ABBEY SPANIER INVESTIGATES THE RYLAND GROUP INC. FOR FAILURE TO PAY OVERTIME COMPENSATION TO ITS SALESPERSONS IN VIOLATION OF THE FAIR LABOR STANDARDS ACT AND STATE WAGE AND HOUR LAWS

Abbey Spanier is currently investigating Ryland for unfair employment practices. Ryland allegedly misclassifies its salespersons as exempt from the overtime requirements of the federal Fair Labor Standards Act (the "FLSA"). The FLSA requires that most employees in the United States be paid at least the federal minimum wage for all hours worked and overtime pay at time and one-half the regular rate of pay for all hours worked over 40 hours in a workweek. Abbey Spanier is also investigating whether Ryland salespersons worked without receiving any compensation in some pay periods.
